Terms & Conditions

This is a template policy provided as a starting point. It should be reviewed and adapted by qualified legal counsel before publication, to reflect your organization's actual services, jurisdictions, and contractual arrangements.

These Terms & Conditions ("Terms") govern access to and use of the ORBIT platform (the "Platform") by administrators, OEPs, HR companies, employers, and candidates (together, "Users"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Eligibility and Accounts

Accounts are created or approved by an administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.

2. Acceptable Use

You agree not to:

  • Submit false, fraudulent, or misleading information about a candidate, agent, HR company, or employer.
  • Use the Platform for any unlawful purpose, including circumventing immigration or labor laws.
  • Attempt to access data or accounts you are not authorized to view.
  • Upload malicious files or attempt to disrupt the Platform's operation or security.

3. Roles and Responsibilities

  • OEPs and HR companies are responsible for the accuracy of candidate and job information they submit, and for their own compliance with applicable recruitment and labor regulations.
  • Employers are responsible for the accuracy of job requisitions and for lawful employment of placed candidates.
  • Candidates are responsible for providing accurate personal, identity, and travel documentation.

4. Payments and Ledger

Payments, fees, and balances recorded on the Platform (including agent, HR company, and candidate ledgers) reflect transactions as reported by administrators and are subject to the payment terms agreed between the relevant parties outside the Platform, unless otherwise stated.

5. Intellectual Property

The Platform, its design, and underlying software are the property of ORBIT or its licensors. Users retain ownership of the candidate, business, and document data they submit, and grant us a license to process it solely to operate the Platform.

6. Suspension and Termination

We may suspend or terminate access to the Platform for any User who violates these Terms, engages in fraudulent activity, or poses a security risk to the Platform or other Users.

7. Disclaimer and Limitation of Liability

The Platform is provided "as is". We do not guarantee that any candidate placement, visa application, or job requisition will be successful. To the maximum extent permitted by law, ORBIT is not liable for indirect, incidental, or consequential damages arising from use of the Platform.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
